Hadiya’s case rewinds: Muslim man wants converted wife to be freed from parents custody

Haldwani: A man from Uttarakhand has requested the Supreme Court that his wife to be freed from her parents’ custody. Twenty-year-old Aisha alias Shweta Bhist converted to Islam and eloped with 23-year-old Mohammad Danish as her parents were against their relationship. The couple who hails from Haldwani got married in Delhi on April 19.

A Hindustan Times report said that Supreme Court has now asked the Uttarakhand Police to produce Aisha before it. Danish had on Monday told a bench led by Chief Justice of India Dipak Misra that he was arrested for ‘abducting’ his wife and was taken into custody. Aisha’s parents lodged an abduction complaint against Danish and the Uttarakhand Police arrested the couple from Delhi.

“We want to talk to the girl and know what she wants. Does she want to stay with her parents or otherwise,” CJI Misra said, ordering Aisha be in the court on Wednesday.

The petition filed by Danish said, Aisha converted to Islam of her own free will and they got the marriage registered in Ghaziabad. The Uttrakhand government disregarded the petition and deputy advocate general Manoj Gorkela said: “The marriage certificate and the nikahnama are fake and it is a case of abduction.”

The Supreme Court in March had restored the marriage of 26-year-old Hadiya who converted to Islam and got married to a Muslim man Shafin Jahan. The Kerala High Court had annulled Hadiya’s marriage when her father had approached the court. However, the SC in a landmark decision upheld a woman’s right to choose partner.
